Jewelry "wholeseller" maker not fulfilling orders, Better Business Bureau says about Heidi J. Hale . read new comments Here (updated 10/18/07)

MUNCIE -- The Better Business Bureau is warning that a Muncie jewelry maker was not filling orders placed through her Web site.

Heidi J. Hale says she was overwhelmed by the number of orders she received.

The BBB says small businesses -- and consumers -- can learn a lesson from the increasingly common problem.

Indianapolis resident Bob Harper might be typical of consumers who ordered jewelry from Hale but didn't get what he paid for.

Harper paid $153 for two bracelets and a pair of earrings from Hale, an artist and jewelry maker who has been profiled in The Star Press and whose designs have been featured in numerous magazines.

"I placed the order the first few days of September," Harper told The Star Press. "She hasn't responded to any of my e-mails. I have heard nothing from those people at all."

Linda Carmody of the Central Indiana Better Business Bureau said her office has received five complaints from customers who paid for jewelry but did not receive it. Among the complaints were people who sent Hale $315, $269 and $52 for jewelry and never received their merchandise.

"I think it happens on a regular basis," Carmody says. "A small business puts up a Website and people buy from them and they just can't keep up. I don't know if that's the situation here, but it happens."

Hale said she was overwhelmed by Internet orders.

"We did over 1,000 pieces over the holidays," Hale said. "We never expected 1,000 units in two months.

"The Internet has been a blessing for me, but I could write a book on having an Internet site."

Hale -- who cited other difficulties as well -- said she's trying to make good on customer orders.

"I have been in contact with a few of those people," she said.

Harper said the experience did not make him less likely to order over the Internet.

"I just bought something yesterday," he said.

Carmody said Hale also improperly advertised as a wholesale jeweler. According to the Federal Trade Commission, Carmody said, true wholesalers must make most of their sales to retailers and Hale was not doing that.

Hi Danny,
 
I paid Heidi J. Hale $114 on 9/4/07 for two necklaces and a bracelet.  Heidi emailed me immediately after I paid her through PayPal and stated she would be mailing my order at the end of the week. 
 
A few weeks went by and I did not receive my jewelry order, so I emailed Heidi to find out the status of my order.  She did not respond to my emails until approx. a week later.  Finally she emailed me that she was so sorry, but there email server was down and she had not responded to my emails due to the computer problem.  She also left me a message on my home phone that she would be mailing me my jewelry order on 10/1/07 and to contact her if I did not receive my order within the next 5-7 days. 
 
As of today 10/17/07, I have not received my order.  So I have sent one email per day (7 emails total) to Heidi from 10/10-10/17/07 and she is not responding to my emails.  I sent her a final email today stating that if she does not refund my $114 or mail me my jewelry order, then I will be forced to contact the BBB and PayPal. 
 
Do you or anyone else have any suggestion on how I could get this resolved?   
 
I checked Heidi's jewelry business online and it is currently accepting jewelry orders and of course money.
 
I feel I am being taking advantage of and basically ripped off. 
 
Any advice would be greatly appreciated.

"I have had a horrible experience ordering from Heidi Hale. I would strongly deter anyone from ordering from her site as the response rate is extremely slow, if at all. I order two necklaces from the site and both arrive about 1 month later after much emailing. The length was too short on both and I asked if I could exchange them. I got a reply that I could, so I sent them back. Bad mistake. I never heard from her again. It's been over two months now. I am under the impression that she either died or else relocated to Tibet. I have called and emailed her multiple times to get any sign of an order status with no avail. Her jewerly is nice and she seems like a nice person from the emails I have received. I just cannot understand how she can IGNORE her customers for months at a time. She's lost my business completely. Chris from TX."

Just to set the record straight, I think that more than one person has been taken by Heidi J. Hale.  I too have ordered from Heidi for over 2 years.  I am one of her wholesale customers that has taken great pride in selling her jewelry.  She has beautiful items and her work is outstanding.  But, at what point does a person feel that they can take your money and not respond to you for over four months and never send you the product that you ordered.  Then after they have been turned in to the Better Business Bureau and they know they are getting complaints, they call and tell you that they will refund your money to you within one week.  Well, it's been 3 weeks and still NO money and No jewelry!  That is not the way to do business if you plan to thrive and grow your company.  Had she told me she was overwhelmed and would not be able to get my product to me, then returned my money I would not have a problem with that.  But, don't continuously lie to me and then take my money!  I know I am not the only person out there that this has happened to!  We're not talking about the price of 1 necklace either.

Just to clarify something...I don't know much about Heidi's personal life. I was just saying that I have several pieces and I know several other folks who do as well and we have never had any problems whatsoever! I spoke to her philanthropy not to be personal, but rather to point out the additional "good things" she has done from a business stand point. I do understand how it would be frustrating to not get your order or good communication. I'm a consumer as well. I just don't see how this is newsworthy and how some growing pains mistakes result in an attempt to ruin someone's business.

Just to clarify something.....I ordered my Heidi J. Hale pieces in SUMMER....not the holiday season, as I suspect the other customers have. In fact, I have talked to quite a few people who were not involved in the BBB complaint that had quite a few complaints about Heidi's business practices. I really don't care how you defend her and her personal life...it is the business aspect of her life that matters. The couple of times I did talk to her about my order, she flat out lied to me about certain aspects, so I am really not feeling too sorry for her.

I, as well as several of my friends have several Heidi Hale pieces of jewelry. I have found Heidi to be very available and responsive! She has filled every order in a very timely manner with an extremely high level of personal attention. I've also noticed that she has donated many pieces of her lovely jewelry to be raffle or auction items to help groups with worthy causes. It appears to me that Heidi is not only a gifted artist, but a successful business woman and a philanthropist as well. Perhaps Heidi did find herself overwhelmed this holiday season, I don't know as I didn't have that experience with my several gifts. If however that was the case, why is that so newsworthy? I had 2 experiences where items never came during holiday online shopping and I didn't see those businesses in the paper. Why vilify a local artist who is also a lovely person? I recently began my own business and I believe that no one can be an immediately perfect business person. We can do our best and we will ALL undoubtably have those situations that we didn't foresee, but from which we can learn. Let's give Heidi a break--I know she did her best and will learn from this! Note the recent change on her website.

The thought that struck me was that one of the frustrated customers contacted the BBB then Keith. I figure it was Bob Harper, and then Keith contact the BBB to verify that complaints had actually been filed for his story.

Unless you have walked in another persons shoes, you don't have any idea what you are talking about. 

Reading these comments you can see the ignorance of Muncie. 

Hmmmmm! 5 customers out of 10,000 in 4 years and the BBB contacts The Star Press to try and destroy Heidi J. Hale. I wonder what that's all about. I would think with those numbers all of the businesses in Muncie would be in our award winning The Star Press. 
The BBB does not contact local newspapers to report a business with 5 complaints. This story has more to it than is being reported.
